International seminar on 10th anniversary of China's anti-dumping legislation and practice held

  





From Jun 25 to 26, 2007, International seminar on 10th anniversary of China’s anti-dumping legislation and practice, sponsored by MOFCOM, was held in Beijing. Vice Minister Gao Hucheng and China’s Ambassador and Permanent Representative to the WTO Sun Zhenyu were present at the meeting and made speeches. At the seminar, officials from WTO secretariat analyzed and looked ahead on the anti-dumping rules talks of Doha round. Officials from trade remedy investigation institutions of such countries and regions as Pakistan, EU, USA, Brazil, Australia and South Africa made a briefing on their own anti-dumping legal system and practice. Representatives from Legislative Affairs Office of the State Council, Ministry of Commerce, Ministry of Finance, General Administration of Customs, Ministry of Agriculture and relevant ministries were present at the seminar, as well as the representatives from China’s colleges, research institutions, chambers and associations, enterprises and law offices. The attendees intensively studied relevant issues on anti-dumping.

Gao Hucheng reviewed China’s legislation, implementing of anti-dumping laws, and the progress of maintaining fair trading order in the last 10 years. He said that Anti-Dumping and Anti-Subsidy Regulations of the People's Republic of China was formally released in March 1997, China initiated the first anti-dumping investigation on imported newsprint in Dec 1997 adhere to the Regulations. In the 10 years from 1997 till now, China has set up anti-dumping legal system, organized and established anti-dumping investigation institutions. The awareness of protecting by using international general regulations of China’s industries was facilitated. Meanwhile undertaking capacity and participating constitution of the international general rules of investigation institutions kept improving, talents for anti-dumping expanded continuously.

Gao pointed out that, according to the practice, impact of overseas dumping produce to China’s industry could be restrained and fair competitive trading order could be maintained through implementing of anti-dumping measures, what’s more the injured industry’s production could be resumed and industrial competitiveness could be promoted. He expressed that China, under the new situation of positively undertaking measures on expanding export, should properly conduct relationship between export expansion and maintaining of domestic indutries’ development. China would rigidly abide by WTO regulations and domestic laws and rules, avoid misuse of anti-dumping measures in practice, so as to represent indeed the trade remedy substance of anti-dumping measures on restraining unfair competition and maintaining of fair trading order.

Sun Zhenyu made a briefing on international anti-dumping developing tendency and situation Doha round talks. He also put forth specific suggestions and requirements on better taking trade remedy work. Firstly, China should promote study on Doha round talks and vigorously participated in multilateral rules’s constitution. Secondly, System development should be facilitated so as to mature and improve China’s trade remedy system. Thirdly, China should promote bilateral and multilateral exchange and study for the purpose of cultivating China’s trade remedy talents.
